Loyalty Program Terms and Conditions
This is a courtesy English translation. In case of any discrepancy, the Spanish version prevails.
1. What PunchyPass is and who operates these terms
PunchyPass is the platform that the business where you sign up uses to operate its loyalty program: it issues your digital card, keeps track of your stamps, and records the rewards you earn. The platform is operated by Astral Restaurant Systems, with its address at Sinaloa 179, Roma Norte, Mexico City ("PunchyPass", "we").
These terms govern only your participation as a customer in a loyalty program. They are different from the Terms of Service accepted by the businesses that subscribe to PunchyPass.
2. Acceptance when you join
By completing the sign-up and joining the program, you accept these terms and the processing of your data described in our Privacy Notice. If you do not agree, do not join the program.
3. How stamps work
- You collect stamps on your digital card according to the rules defined by the business (for example, one stamp per visit or per purchase).
- The business is the one that validates and applies each stamp. PunchyPass only records and displays your balance; it does not grant stamps on its own.
- Stamps have no monetary value, are not transferable, and cannot be redeemed for cash.
4. Rewards and their validity
When you complete the required stamps you earn the reward described by the program. It is important that you understand the following:
- The business defines and delivers the reward. PunchyPass is not responsible for honoring, substituting, or refunding rewards; that obligation belongs to the business where you participate.
- The business may set reasonable conditions of use (validity period, hours, applicable products) and must communicate them to you.
- Rewards obtained through improper or fraudulent means may be voided.
5. Your card in Wallet
Your loyalty card is stored in Apple Wallet or Google Wallet. It updates automatically when your stamp balance changes. You can remove it from your device at any time; doing so does not delete your participation in the program unless you also ask to opt out (see section 8).
6. The business defines and operates the program
Each business is independent and responsible for its own program: the stamp rules, the rewards, their availability, and customer service. PunchyPass provides the technological infrastructure, but is not a party to the commercial relationship between you and the business. If a business stops using PunchyPass or closes its program, your card and your stamps may no longer be active.
7. Personal data
The data you provide when joining (name, email, date of birth and, optionally, phone number) is processed in accordance with our Privacy Notice, which describes the purposes, the data processors, and how to exercise your ARCO rights.
8. Communications and opting out
By joining, the business may send you promotions and news by email. You can unsubscribe at any time from the footer of any of those emails, or by writing to contacto@punchypass.com. Unsubscribing from communications does not automatically cancel your card; if you also want to delete your participation and your data, say so in your request.
9. Misuse
You may not attempt to collect stamps or rewards through fraudulent, automated, or deceptive means, or impersonate another person. The business may suspend or cancel your participation in case of misuse.
10. Availability and limitation of liability
We make reasonable efforts to keep the service available, but we do not guarantee that it will operate uninterrupted or error-free. To the extent permitted by law, PunchyPass will not be liable for rewards not honored by the business, for the suspension of the program by the business, or for technical interruptions beyond our control.
11. Changes to these terms
We may update these terms to reflect changes in the service or in applicable law. Any modification will be published at this same URL with its new date and version number.
